These Terms of Use form a contract between you and us. They set out how you may use NetCaptain, what we are responsible for, and what you are responsible for. We have written them in plain language so that they can be read and understood without specialist help.
How we handle personal information is set out separately in our Privacy Policy.
1. Who these terms apply to
These Terms of Use apply to anyone who uses any part of NetCaptain, whether you are a coach using the web console, a player or guardian using the mobile app, or a visitor browsing our website. We use "you" throughout to mean whoever is using NetCaptain at the time.
If you are an organisation running cricket training on NetCaptain, you also enter into a separate agreement with us called the Organisation Agreement. That agreement covers matters specific to running an organisation on NetCaptain, including fees, your responsibilities to your players, and how we handle the data you put into NetCaptain. These Terms of Use apply to you in addition to that agreement.
By using NetCaptain, you agree to these Terms of Use. If you do not agree, please do not use NetCaptain.
2. About NetCaptain
NetCaptain is operated by Net Captain Pty Ltd (ACN 697 458 281), with its registered office at Level 1/14-16 Yarra St, South Yarra VIC 3141, Australia. We refer to ourselves throughout as "NetCaptain," "we," or "us."
NetCaptain is a platform for planning cricket net sessions. The training itself, including the sessions, squads, selections, and schedules available through NetCaptain, is not provided by us. It is provided by the organisations who use NetCaptain to run their training: clubs, schools, academies, county and district associations, and other bodies. We refer to these throughout as "organisations." This distinction is important and shapes much of what follows.
3. Your organisation relationship
Your access to NetCaptain as a player or guardian exists because an organisation brought you in: a coach added you to their roster, sent you an invite, or shared a join code with you. Your relationship in respect of the cricket is with that organisation, not with NetCaptain. The organisation is responsible for:
Running its training sessions, including when they happen, where, and who is selected
The safety and supervision of its sessions and venues
Its own membership, selection, and conduct policies
The accuracy of its roster, including the details it records about you
Handling questions, complaints, or disputes about its training and its decisions
NetCaptain's role is to provide the platform that the organisation uses to plan its sessions and communicate with you. We do not run the sessions, pick the squads, or supervise the cricket. We work to keep the platform operating well, but the organisation is the party responsible for the training itself.
If you have a question about a session, your selection, your grades, or anything else about the cricket, you should contact your organisation directly.
4. Your account and profile
You sign in to NetCaptain with a one-time code we email you, or, on the web console, with Google. The player app does not use a password.
Your account is yours, not your organisation's. It holds your sign-in email, the name held against your account, your notification devices, and your memberships. If you belong to more than one organisation on NetCaptain, one account covers all of them.
You are responsible for keeping access to your account secure, including the email inbox your sign-in codes are sent to. If you believe someone else has accessed your account, please notify us at [email protected].
Your organisation separately holds a roster record about you: your name and contact details, your squads, grades, and playing roles, and, for a player under 18, a guardian's contact details. That record belongs to the organisation and exists whether or not you have an account. As a player you can edit your own name, email, and mobile number on it through the app; editing them yourself does not change that the record is the organisation's. Our Privacy Policy explains how the two relate.
You must provide accurate information. If you enter details on someone else's behalf, you must have their permission, or, for a child in your care, the authority to do so.
5. Players under 18, and guardians
NetCaptain is built for junior cricket as well as senior cricket, and handles players under 18 deliberately rather than incidentally.
If a player is under 15, they cannot set up their own access. A parent or guardian must set up the player's access first, and the player can then sign in using the access their guardian arranged. Our systems enforce this.
If a player is 15, 16, or 17, they may set up their own access. We ask for a parent or guardian's contact details as part of that, and the organisation holds those details as the safeguarding contact for the player.
Guardians hold their own accounts. A guardian's account can act for a player in their care: seeing their sessions, answering RSVPs, and receiving notifications about them. Where a guardian sets up access for a player under 15, the guardian accepts these Terms of Use on the player's behalf, and remains responsible for the player's use of NetCaptain.
A player's record can list a guardian as a safeguarding contact whether or not that guardian uses the app. Those details are entered and corrected by the organisation's coaches or by the guardian, never shown to other players, and used to route communications about the player.
If you are a guardian and believe a child in your care is using NetCaptain without appropriate arrangements, or you want a child's record removed, contact the organisation's coach or write to us at [email protected].
6. Acceptable use
To keep NetCaptain safe and useful for everyone, you must not:
Use NetCaptain to do anything illegal, harmful, or harassing
Disrupt, damage, or attempt to gain unauthorised access to NetCaptain or any account
Use NetCaptain to send spam, scrape content, or operate automated tools without our permission
Use NetCaptain in any way that misrepresents your identity or brings NetCaptain into disrepute
If you do any of these things, we may suspend or close your account and, where appropriate, report the matter to relevant authorities.
7. Content you post
If you post content on NetCaptain, such as a note, message, or announcement, you retain ownership of it but grant us permission to store, display, and transmit it as part of operating the platform. You must not post content that is unlawful, infringes the rights of others, or breaches these Terms of Use.
We do not actively monitor all content posted on NetCaptain, but we may remove content that breaches these terms, and will do so where we consider there is a risk of harm.
8. What we do not warrant
We aim to keep NetCaptain operating reliably, but we do not warrant that the platform will always be available, error-free, or completely secure. The platform may occasionally be unavailable due to maintenance, technical issues, or third-party outages.
We do not warrant that any session shown in NetCaptain will go ahead, that a schedule is final, or that the information an organisation has entered is accurate. Those matters are the organisation's responsibility.
9. Limitation of liability
To the extent permitted by law, our liability to you in connection with your use of NetCaptain is limited. We are not responsible for:
The training itself, including how sessions are run, whether they go ahead, selection decisions, or the safety and supervision of sessions and venues
The accuracy of information entered by an organisation
Indirect or consequential losses
Matters outside our reasonable control, including outages of third-party services or events of force majeure
Nothing in these Terms of Use limits any rights you have under the Australian Consumer Law, or, if you are in the United Kingdom, under UK consumer law, or under any other law that cannot be excluded. If a court determines that any part of this section is unenforceable, the remaining parts continue to apply.
10. Privacy
Our handling of personal information is set out in our Privacy Policy. The Privacy Policy describes what we collect, how we use it, who we share it with, and the rights available to you.
We do not sell personal information, and we do not use it for marketing without your consent.
11. Changes to these terms
We may update these Terms of Use from time to time, including to reflect new features, changes in the law, or improvements in clarity. Where we make material changes, we will post an updated version with a new "last updated" date and, where you have an account with us, notify you by email at least 30 days before the changes take effect.
Continued use of NetCaptain after the changes take effect constitutes acceptance of the updated terms. If you do not agree to the updated terms, you may stop using NetCaptain and delete your account.
12. Deleting your account
You can delete your account yourself, from inside the app: Profile → Delete my account. Deletion is immediate and cannot be undone. It removes your login, your account profile, and your notification devices, and signs you out of every organisation.
Two things to know:
Your organisation's roster record of you is not removed by this, because it belongs to the organisation rather than to your login. Deleting your account releases the record so that no account is attached to it. To have the record erased too, ask a coach at your organisation, or write to [email protected] and we will pass the request on.
If you are the only owner of an organisation, transfer ownership to somebody else first. Otherwise deleting your account would leave the organisation with nobody able to run it. The app will tell you if this applies to you.
We may suspend or close your account if you breach these Terms of Use or where we have reasonable grounds to believe your use of NetCaptain presents a risk to us, an organisation, or other users.
13. Governing law
These Terms of Use are governed by the laws of Victoria, Australia. The courts of Victoria have jurisdiction in respect of any dispute that cannot be resolved informally. If you are a consumer in the United Kingdom, this does not deprive you of the protection of provisions of UK law that cannot be departed from by agreement.
